Jailbreaking the iPhone is Illegal…. according to Apple.

Apple has made it’s first formal public statement about it’s legal stance on iPhone jailbreaking in comments filed with the Copyright Office.

Apple states;

“Current jailbreak techniques now in widespread use utilize unauthorized modifications to
the copyrighted bootloader and OS, resulting in infringement of the copyrights in those
programs. For example, the current most popular jailbreaking software for the iPhone,
PwnageTool, causes a modified bootloader and OS to be
installed in the iPhone, resulting in infringement of Apple’s reproduction and derivative works
rights.

In addition, as discussed in
Section II.B.2 above, the jailbroken OS enables pirated copies of Apple copyrighted content and
other third party content such as games and applications to play on the iPhone, resulting in
further infringing uses of copyrighted works and diminished incentive to create those works in
the first place.”

 

The Electronic Frontier Foundation has asked the Copyright Office to create an exemption to allow iPhone owners to run applications that are not available from the AppStore on their phones.

So, it looks like Apple is attempting to clamp down on jailbreakers, which I am sure will alienate some users.

    YEAH SURE…… now apple is going to ban jaibreaking? next if we take a sledgehammer and crush imacs are they gonna throw us in jail and fine us 5k? it is our damn iphone and i don’t care if i am breaking the damn warranty, i just don’t want it to be illegal! Apple might create the best software and hardware ever, but their limitation is just too much…… i swear one of these days i am changing into WINDOWS MOBILE DAMN IT. BTW is ipod touch invovled? is it illegal then if you jailbreak the ipodtouch?

    sry for my rant though, i just think it is wrong that apple is restraining users like that

    This has been turned down. Old news.

    It is sad that everyone is loosing out for a few pirates though. Ruining all the fun. Hopefully this will be like psytar and osx86. Apple stills allows blatant cheatery to run OS X on PCs because it increases their sales of OS disks and potential Mac buyers.

    This is the most retarded thing apple has ever done. People will still find a way to jailbreak their iPhone/Touch and apple can’t find out millions of ip adresses to ban from AppStore and I’m sure that someone on Cydia or Installer will make an app that allows jailbreakers to get unto AppStore. Besides we PAYED for this so we should be able to do what we want with it.
