Apple Hit With Class-Action Lawsuit Over iPhone 3G Defectiveness

A lawsuit has been filed against Apple over what the plaintiff Jessica Alena Smith, is referring to as the “defective iPhone 3G”. She states that the new iPhone’s 3G performance and reliability has been subpar,
despite the claims made by Apple’s aggressive marketing campaign.
Jessica purchased the iPhone 3G a few days after it started going on sale July 11th, after seeing television, radio, and print ads about the device. “One could barely turn on the television without hearing that the new iPhone 3G was ‘twice as fast for half the price,’” reads the complaint.
Jessica notes that immediately after purchasing the iPhone 3G, she noticed that the iPhone’s data connection, e-mail, SMS, and other communications were slower than expected, and that the device only appeared to connect to AT&T’s 3G network less than 25% of the time. She also experienced an “inordinate amount of dropped calls,” according to the lawsuit, despite the fact that Birmingham, Alabama, where Jessica resides, has excellent 3G coverage from AT&T.
Jessica knows that this is not only occurring with her, which is why she is hopping to have her suit be approved as a class-action. Jessica theorizes that the class contains thousands, “perhaps tens of thousands” of members, which is entirely true if what Steve Jobs replied in an e-mail complaint last week stating that 2% of the entire iPhone 3G community is being affected by this issue.
Smith and the class, assuming the suit is approved as a class-action, ask that Apple be ordered to repair or replace all Defective iPhone 3Gs. Additionally, she asks that the company be required to pay unspecified damages, pre- and post-judgment interest on monetary relief, and attorney’s fees.

I’m so glad I just have an iPod Touch. I was talking to a friend the other day and they were saying how great the iPhone is and I said “I have most of what it has, and I don’t have to pay a monthly fee to use it.”
Since they know I have no use for a phone, that shut them up:) Though I do wish they’d left the camera in the iPod. That I DO miss. But not enough to pay a monthly fee.
Can’t say I’m surprised by the lawsuit. Sounds like the 3G is fairly bad.
